A US federal judge has declined to immediately dismiss the criminal case against Indian billionaire Gautam Adani, instead directing the Justice Department to provide a more detailed explanation for its request to abandon the prosecution. This decision by US District Judge Nicholas Garaufis, overseeing the case in Brooklyn, puts a spotlight on the Justice Department’s move to drop charges that were initially filed during the final months of the former Biden administration.

Judge Garaufis stated that the Justice Department’s initial filing, which sought dismissal, lacked sufficient information for the court to properly assess the request. "The Government’s terse, bland and conclusory statement affords the court neither a sufficient basis to reach any conclusion, nor the opportunity to conduct any analysis of the Government’s request for dismissal," Garaufis wrote, as quoted by Reuters. He has ordered prosecutors to submit a comprehensive explanation by July 13 before he will consider formally dismissing the case.

The charges against Adani, filed in 2024, accused him of securities fraud and wire fraud. These allegations were linked to an alleged bribery scheme in India. Prosecutors had claimed Adani agreed to pay bribes to Indian government officials to secure approvals for an Adani Group subsidiary’s solar energy project. Furthermore, he was accused of misleading US investors by presenting the company’s anti-corruption practices more favorably than they actually were.

The Justice Department’s recent move to drop the prosecution against Adani, his nephew Sagar Adani, and six others, marked a significant shift. This action aligns with a pattern seen under the current administration, which has sought to end several high-profile white-collar criminal cases initiated during the previous administration. The prosecutors who originally brought the case did not sign the dismissal request, a detail that adds another layer of scrutiny to the department’s current position.

Adani Group has consistently denied all allegations of wrongdoing since the charges were brought. Gautam Adani himself has not appeared before a US court to respond to these accusations. His legal team, led by Robert Giuffra, had also sought immediate dismissal of the case, arguing that the alleged conduct fell outside the scope of US law and that prosecutors would be unable to prove the alleged bribery in India.

Giuffra informed the court in a June 24 letter that Adani’s legal team had engaged in multiple meetings with Justice Department officials. They submitted nearly 500 pages of material, outlining what they described as significant legal and factual weaknesses in the prosecution’s case. Giuffra contended that the Justice Department’s decision to withdraw the case reflected its careful consideration of these identified flaws.

In its May 18 filing, senior Justice Department officials had simply told the court they decided, "in its prosecutorial discretion," not to dedicate further government resources to pursuing the criminal case. Judge Garaufis found this explanation inadequate, demanding a more detailed justification for their request to drop such a high-profile case. This judicial order underscores the court’s role in ensuring transparency and accountability, even when the executive branch seeks to discontinue a prosecution.

The judge’s demand for a fuller explanation means the Justice Department must now articulate its reasoning in detail. This development ensures that the decision to drop charges against a prominent international figure like Gautam Adani will not be a mere formality. The outcome of this justification, due by mid-July, will determine the future of these criminal proceedings and could set a precedent for similar high-profile cases.
