To his utter horror, the parcel did not contain the sleek Apple flagship device. Instead, inside lay a green-colored fake Chinese smartphone stamped with a dubious Apple logo. While an original iPhone 14 Pro famously features a triple-camera setup on the rear, the counterfeit phone pulled from the box possessed only two camera lenses.

Customer Support Nightmare and Summary Rejections

Hoping for a quick resolution to an obvious mix-up or fraud, the distressed buyer immediately lodged a complaint with Flipkart’s customer care service and filed an official return request. What followed was a frustrating ordeal of customer indifference and neglect. The seller on the platform flatly rejected the return request without conducting a proper verification or investigation. Adding insult to injury, company representatives dismissed the customer’s plight by claiming the product was damaged, refusing both a replacement and a full refund.

Left stranded despite having recorded video evidence of the unboxing in the presence of the delivery personnel, the consumer realized that customer support channels were leading to a dead end. The utter lack of accountability from a major e-commerce platform forced the victim to seek legal intervention to reclaim his hard-earned money.

Legal Battle at Bulandshahr District Consumer Commission

Refusing to accept the unjust loss of Rs 1,43,335, Om Prakash Singh approached the Bulandshahr District Consumer Commission on August 3, 2023, seeking justice against the e-commerce giant. During the proceedings, Flipkart attempted to shield itself from liability by arguing that it acted purely as an intermediary platform connecting buyers and third-party sellers, and thus could not be held directly responsible for the contents of the shipment.

The Consumer Commission firmly rejected Flipkart’s defense, ruling that the company cannot wash its hands of responsibility when serious service deficiencies occur on its platform. The court observed that the e-commerce giant engaged in unfair trade practices and demonstrated severe deficiencies in service quality.

The Verdict: Refund, Interest, and Compensation Penalty

In a decisive judgment that brings relief to harassed online shoppers, the Bulandshahr District Consumer Commission ordered Flipkart to take back the fake Chinese smartphone and issue a full refund of Rs 1,43,335 to the customer. To compensate for the delay and financial loss, the commission mandated that the refunded amount must carry an annual interest rate of 7 percent from the date of filing.

Recognizing the emotional stress and harassment faced by the buyer while dealing with unsupportive customer service representatives, the court ordered Flipkart to pay an additional Rs 20,000 as compensation for mental agony. Furthermore, Flipkart was instructed to pay Rs 10,000 toward the litigation expenses incurred by the victim during his legal struggle, bringing the total extra compensation to Rs 30,000.

The commission has stipulated a strict deadline of 45 days for Flipkart to comply with the entire order. The ruling explicitly warned that if the company fails to execute the payment within the prescribed 45-day timeframe, an escalated penal interest rate of 8 percent per annum will be applied to the outstanding balance until full realization.
